Gretchen Rossi Asked To Fork Over $40,000 To Ex, Simon Barney Files Bankruptcy

More bad news for Real Housewives of Orange County star Gretchen Rossi.

Just months after being forced to pay over $22,000 in attorney fees to her ex-boyfriend Jay Photoglou, RadarOnline is now reporting Orange County Superior Court Judge Gregory Munoz tentatively ruled on Wednesday that Jay be awarded fees and costs of $40,799.38 as a result of an anti-SLAPP motion he filed. The official ruling is expected to be finalized any day now.

This all stems from Jay’s lawsuit against Gretchen for libel, slander and five other counts. “We filed a motion for attorneys fees asking for $80,000 knowing, the truth is, the best we could do is probably get half that because we won half the motion,” Jay’s attorney Bryan J. Freedman told RadarOnline.

Gretchen, who filed a counter suit against Jay for defamation, suffered another legal blow two months ago when the same judge threw out a huge portion of her lawsuit against Jay, including claims of defamation, slander and portrayal in a false light.

Jay is also suing Gretchen for defamation. Jay’s case stems from Gretchen’s claims that she was never romantically involved with him though the countless number of photos leaked out by him show otherwise.

“But the good part is she’ll be writing a check for $40,000 or be held in contempt of court,” Jay’s attorney added.

In other OC news, it seems there’s yet another bankruptcy to report. According to Jezebel.com, Simon Barney, estranged husband of Tamra Barney, filed bankruptcy on December 2, 2010. While no additional details were reported, the site reveals it was chapter 13 bankruptcy. We will bring you more details as soon as we get our hands on it.
