Aaaaahhhh… The Bethenny Frankel divorce saga rages on – and things are getting really heated over a certain skinnygirl luxury apartment!
It seems Bethenny, via her assistant Molly Hayden, is the sole owner of the pad which we saw her extensively renovating (to her own specifications and needs) on Bethenny Ever After. Guess this explains why Jason Hoppy was ousted out of a man cave!
Molly was Bethenny's assistant for two-years and Bethenny purchased the apartment in Molly's name via MYC Trust. Which means Jason could have little to no claim or stake in the property. Does anyone recall seeing Molly on any of Bethenny's shows?

Regardless of what the property deed says, Jason is refusing to move out until a custody agreement for two-year-old Bryn is ironed out. Interestingly according to NY State law Jason actually has legal standing in refusing to vacate the shared marital home. It seems Bethie legally CANNOT evict her estranged hubby!
A big-name NYC divorce lawyer informs the Daily Mail: "Under New York law you can’t evict a spouse from a property that a spouse is living in unless there is violence. Removing either a husband or wife from an apartment is the same as evicting them, and you can't evict without significant abuse or violence."
BETHENNY RECOVERING FROM SEPARATION!
Essentially Bethenny needs to prove Jason is abusing her and um…. well we've all seen the last two seasons of BEA so we know that's not gonna fly! "You need to show a very compelling reason," the lawyer explains. "Bethenny can't get Jason out." Even worse, she can't sell the apartment until the divorce is finalized! "Even if Bethenny bought the apartment, it's still marital property."
And If Jason moves out on his own volition Bethenny could cite abandonment.
Apparently Bethenny has retained a friendship with this Molly, a photo is below, but it's unsure about why the apartment would be purchased in her name. Odd, to say the least.
