Finally, there’s been a little bit of progress in the divorce battle between Porsha Williams and Simon Guobadia. The estranged exes have been battling in court over pretty much everything. Their prenup and Porsha’s return to The Real Housewives of Atlanta were the main sticking points. Now, Porsha just scored a major win with a judge, meaning she’s one step closer to being a single woman.
How Porsha scored a big victory in her court battle amid ongoing divorce from Simon Guobadia
From the moment Porsha and Simon called it quits, they’ve been at each other’s throats both in the courtroom and online. They both accused each other of violating the prenup, but Simon put his foot down over Porsha’s RHOA return. He claimed that when they exchanged vows, he was under the impression that Porsha was signing up to be a stay-at-home mom. When she inked that new deal with NBCUniversal, Simon felt like that changed the context of their relationship.
In a court filing, Simon demanded that the production company behind RHOA fork over every single detail about her return. He even asked for a videotaped deposition, all in hopes of finding their prenup unenforceable. Meanwhile, Porsha and her lawyers filed motions to try to get all of this quashed.
After sitting in limbo for a bit, a judge finally ruled on the matter. According to a report from People, the court sided with Porsha, and you know that’s driving Simon crazy. Essentially, the judge said Simon’s claims had “no merit.” He should have known that a return to TV was possible when marrying a reality TV star.
The ruling stated, “The Court finds that Wife has been a reality TV celebrity for years, which was well known to Husband at the time of negotiating the Prenuptial Agreement, and Husband nevertheless married Wife with this knowledge.”
Ultimately, the judge felt like Porsha and Simon spent plenty of time drafting up their prenup. If he had concerns about her returning to TV, he should have spelled it out in the agreement.
The ruling explained, “The Prenuptial Agreement at issue in this case was negotiated by the parties with very competent lawyers over a year length of time, and included the exchange of financial disclosures, such that the issues of fraud, mistake, misrepresentation, and duress are clearly addressed in multiple provisions of the Prenuptial Agreement.”
Not only did the court side with Porsha on this matter, but they also ordered Simon to pay her attorney’s fees and other legal expenses. It’s a win across the board for Porsha. Now, a court just has to officially uphold their prenup, and she can wash her hands of this mess once and for all.
